{"id":2282,"date":"2023-07-16T23:34:35","date_gmt":"2023-07-16T23:34:35","guid":{"rendered":"https:\/\/mkonsulting.ma\/blog\/2023\/07\/16\/new-inheritance-rules-for-non-muslim-expats-in-the-united-arab-emirates\/"},"modified":"2024-03-15T15:07:24","modified_gmt":"2024-03-15T15:07:24","slug":"new-inheritance-rules-for-non-muslim-expats-in-the-united-arab-emirates","status":"publish","type":"post","link":"https:\/\/mkonsulting.ma\/en\/new-inheritance-rules-for-non-muslim-expats-in-the-united-arab-emirates\/","title":{"rendered":"New Inheritance rules for Non-Muslim Expats In The United Arab Emirates."},"content":{"rendered":"&#13;\n<p class=\"wp-block-paragraph\"><strong>A new Federal Decree-Law No. 41 of 2022 on Civil Personal Status of all non-Muslim to be enforced from February, 2023.<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>Which people are concerned by the new federal personal status law ?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">The new Federal Decree-Law No. 41 of 2022 governs the following :<\/p>&#13;\n\r\n<ul class=\"wp-block-list\">&#13;\n<li>Non-Muslim citizens of the UAE<\/li>&#13;\n\r\n\r\n&#13;\n<li>Non-Muslim expatriates and residents of the UAE, unless one of them insists that the law of their own country be applied in matters related inheritance and wills.<\/li>&#13;\n<\/ul>\r\n&#13;\n<p class=\"wp-block-paragraph\"><strong>What does the new law say on matters of wills ?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">With the new law, Non-Muslims will be allowed to give their assets to anyone they wish.\u00a0<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">Also, the new legislation allows for both spouses to complete a will registration form while finalizing their marriage contract, outlining the distribution of their assets in the event of their death.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>What is stated in the new law regarding inheritance ?<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>Law No. 41<\/strong> deals the determination of Inheritance for non-Muslims and removes the traditional default distribution which includes an unequal distribution between males and females.<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><strong>Under the reforms, in the absence of a valid Will :\u00a0<\/strong><\/p>&#13;\n\r\n<ul class=\"wp-block-list\">&#13;\n<li><strong>Half (1\/2) of the estate<\/strong> shall be inherited by a <strong>surviving spouse<\/strong>.<\/li>&#13;\n\r\n\r\n&#13;\n<li>Should the deceased leave any <strong>surviving children<\/strong>, the remainder of the estate shall be <strong>distributed equally among the children<\/strong> with no differentiation between males and females.\u00a0<\/li>&#13;\n\r\n\r\n&#13;\n<li>In the event that a deceased leaves no children, the estate shall be <strong>divided equally to the surviving parents<\/strong>.<\/li>&#13;\n\r\n\r\n&#13;\n<li>Should only one parent remain, the estate shall be distributed equally between said <strong>parent and surviving siblings<\/strong> of the deceased, equally.\u00a0<\/li>&#13;\n\r\n\r\n&#13;\n<li>In the event where both parents have passed away, the estate shall be divided equally, amongst <strong>the surviving siblings<\/strong>, with no distinction between brothers and sisters.<\/li>&#13;\n<\/ul>\r\n&#13;\n<p class=\"wp-block-paragraph\"><strong>Contact Us<\/strong><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\">+212 5 22 26 59 90<\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><a href=\"mailto:info@mkonsulting.ma\">info@mkonsulting.ma<\/a><\/p>&#13;\n&#13;\n<p class=\"wp-block-paragraph\"><em>Disclaimer : The content of this article is intended to provide a general guide to the subject matter.
